I received a letter today from the attorneys on this case and it looks like a date of March 4, 2019 has been set for the Chrysler portion. A couple months shy of the 10 year anniversary of "The Letter".

Ted B. Lyon & Associates claims that Steven RATtner and Ron Bloom have been deposed. I won't go into the rest of the letter but It should be interesting to see what happens. I'd love to be more positive but I'm not holding my breath. I wonder if the proceedings will be available on pay per view..................

Trial is delayed due to the government shutdown. New schedule to be proposed when the shutdown ends.

Thanks for the update. Well it will be over a decade since the closures by the time the trial starts. Unbelievable!!

Everything that happens, anywhere, now days is blamed on "Govt Shutdown". Before this, there was still nothing happening. To be fair, I must admit that I'm abit skeptical, and tarnished now in my old age. I hope for all, justice is served.

I'm sure the assholes at Automotive News are writing their 10 year anniversary stories. Belllavia should make sure this gets on there.

Those people should rot on hell for what they did

I received a letter that says trial is set for April 8, 2019 at 9:00 AM. United States Court of Federal Claims. They thought the trial would last 6 weeks.

Let the games begin!

Hello Everyone...sorry for the long absence. We’ve been very busy getting the case ready for trial. After 9 long years we finally start the trial of the case on April 9th. We are projecting a 6 week trial. Many familiar names will be on the stand: Ratner, Nardelli, Press, Grady, Tangeman, and Landry. About 300 rejected Chrysler dealers are the plaintiffs. The defendant is the US Treasury.
Legal issue: Did the government coerce Chrysler into filing bankruptcy and rejecting 25% of its dealers as a condition of receiving a financial bailout ? Or did Chrysler decide to terminate the dealers on its own in order to accelerate Project Genesis ? If the former then the Government is liable under the 5th Amendment of the US Constitution for the unlawful taking of private property (dealer franchises) without “just compensation “. Remember, the Government has the sovereign right to take private property for the public good (here to save the economy from the far reaching devastation of a Chrysler liquidation) but it must compensate the property owner. This is the legal principle of eminent domain. The trial is not about whether it was a wise decision to terminate dealers, but rather who was mandating the closures.
Many of the plaintiff dealers and their families will be attending the opening days of the trial. If you know one of them I’m sure they would appreciate some well wishes from their colleagues. They are a patient, resilient and tenacious group of fighters and it is an honor and a privilege to represent them.

Great News!! It should be interesting to say the least. Thank you for all your hard work. I have to say I am truly surprised this has come to trial. Not that I don't think it should but the amount of time that has passed is staggering. 35 days short of a decade since the letters went out. A 2 term POS (in my opinion) President and 1/2 of the next one's first term have gone by. Pretty amazing how slow the wheels of justice move.

Anyone here on the Forum look to make the trip?

What will happen in the first days?

Would it be better to have lots of dealers there?

Again, thank you for all your help and work and investment of time and money. I wish I would have been in a better position to help with the financial part but even after 10 years I'm still digging out.

i, and I hope other forum members are watching for answers to Steve’s inquiries. As a non plaintiff Former GM dealer I have no dog in this case but am mighty interested in supporting if I can. Possibly a 1 day fly to Washington, sit in court gallery a few hours and fly home.
